[ARCHIVED] Notice of Intent to Request Release of Funds Charter Township of Canton



On or about May 18, 2015 the Charter Township of Canton will submit a request to the US Department of Housing and Urban Development for the release of Community Development Block Grant funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake the following projects: Project 1: Housing Rehabilitation, $150,000 for the purpose of repairing residential homes. Project 2: ADA Improvements to Township Facilities, $ 65,000 for the purpose of bringing township facilities into ADA compliance. Project 3: Historic Preservation, $75,000 for the purpose of preserving a historic landmark. Canton Township will perform a second tier environmental review on each specific property and this information will be kept in a file for documentation purposes.

The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act requirements-- An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the Finance Department, 1150 Canton Center S, Canton MI 48188 where ERR can be examined. This document may be examined or copied weekdays between 9 A.M. and 4 P.M.

Public Comments

Any individual, group, or agency may submit written comments on the ERR to the Finance Dept, 1150 Canton Center S., Canton MI 48188. All comments received by May 18, 2015 will be considered by Canton Township prior to authorizing submission of a request for release of funds.
Release of Funds

The Charter Township of Canton certifies to HUD that Philip J. LaJoy in his capacity as Township Supervisor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows Canton Township to use Program funds.
Objections To Release of Funds

HUD will consider objections to its release of funds and the Charter Township of Canton certification received by May 18, 2015 or for a period of fifteen days following its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Charter Township of Canton; (b) the Charter Township of Canton has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to HUD at McNamara Federal Building, 477 Michigan Avenue, Detroit MI 48226. Potential objectors should contact HUD to verify the actual last day of the objection period.
